A blind U.S. Department of Agriculture employee whose administrative claims were unsuccessful did not assert a viable claim that the federal agency violated section 508 of the Rehabilitation Act by failing to insure that the USDA’s information and electronic technology be accessible to its employees with disabilities, a district. of the federal district court of Columbia ruled. The court concluded that the Rehabilitation Act does not provide him with any cause of action and denied the summary judgment on that basis, but will set up a hearing to discuss his two remaining claims under the Administrative Procedure Act.
