On Saturday, the Indian government issued a final warning on the major social media Twitter for compliance with the new 2021 rules on information technology (intermediate guidelines and code of ethics for digital media).
In a heavily drafted letter, the Ministry of Electronics and Information Technology warned the social media giant that this breach of India’s new IT standards will have unintended consequences, including loss of disclaimer. of Twitter as an intermediary available under section 79 of information technology. Act, 2020. He said that despite sending two warnings, Twitter has not met the new digital standards.

The letter indicated that so far Twitter has not provided details of the compliance head, as required by the rules. He also stressed that the resident claims officer and the named nodal contact person is not an employee of Twitter Inc. in India, as prescribed by the rules. The Ministry also opposed the address of the office provided by Twitter, claiming that the address is that of a law firm, which is also not according to the rules.
“The refusal to do so demonstrates Twitter’s lack of commitment and efforts to provide a safe experience for the people of India on its platform. The world’s largest democracy has been among the top countries in the world, outside the country mother of Twiner Ito, who enthusiastically adopts the Twitter platform, ”the letter said.
He added: “Despite being operational in India for more than a decade, it cannot be believed that Twitter Inc. has stubbornly refused to create mechanisms that allow the people of India to solve their problems. on the platform in a timely and transparent manner and through fair, India-based processes, clearly identified resources.Leave yourself proactively creating this mechanism, Twiner Inc. is in the inflexible group of refusing to do so. even when required by law. ”
The Ministry stated that, although the rules have been in force since May 26, 2021, as a gesture of goodwill, Twitter is being given a final warning to comply immediately with the rules, if the exemption from liability under section 79 of the IT Act, In 2000 it will be withdrawn and Twiner will be liable for the consequences under the IT Act and other criminal laws of India.
Twitter had demanded 3 months of additional time to comply with the new rules
Twitter had strongly opposed the new digital standards notified by the government of India. Although other social media platforms like Facebook, Instagram and Whatsapp have complied with the new laws, Twitter last month asked the government for an additional three months for it.
The 2021 rules on information technology (intermediation guidelines and code of ethics for digital media), which came into force on May 25, oblige social media intermediaries with more than 5 million users and the provision of messaging services to identify the first creator of problematic content that may harm the interests of the country. Companies should also appoint a claims agent from India to deal with complaints.
It should be noted here that in February this year the 2021 rules on information technologies (Intermediary Guidelines and Code of Ethics for Digital Media) were published and that social media companies have already received a period of 3 months to comply the new regulations.
